Copyright and Takedown Policy

1. Reporting a rights issue

Uptify responds to copyright notices under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. Section 512. Send copyright notices to the designated copyright contact at legal@uptify.ai. Our designated agent registration with the U.S. Copyright Office is in progress; until it is listed, send notices to this address. A listing report can alert our review team but does not replace the elements of a statutory notice.

2. What a notice must contain

Provide: (1) your physical or electronic signature as the owner or authorized representative; (2) identification of the copyrighted work, or a representative list for multiple works at one site; (3) identification and location of the material to remove, including listing URLs or specific files; (4) your name, postal address, telephone number and email; (5) a statement that you have a good-faith belief the use is not authorized by the owner, its agent or law; and (6) a statement that the notice is accurate and, under penalty of perjury, you are authorized to act for the owner of the exclusive right allegedly infringed.

Consider licenses, ownership and lawful exceptions such as fair use before sending a notice. Knowingly material misrepresentations in notices or counter-notices can create liability under Section 512(f). Do not include unrelated personal information. Required contact details go privately to our copyright contact, not in marketplace messages.

3. Removal and notice to the Builder

We may remove or disable material promptly after a sufficient notice, notify the affected Builder and provide the notice as needed to resolve the claim. We may request missing information. A review pause or removal is not a judicial finding of infringement. We maintain a policy of terminating repeat infringers in appropriate circumstances and may terminate a serious first violation. We accommodate standard technical measures as required by law.

4. Counter-notice

If you believe material was removed by mistake or misidentification, send a counter-notice to legal@uptify.ai. Include: (1) your physical or electronic signature; (2) identification of the removed material and where it appeared before removal; (3) a statement under penalty of perjury that you have a good-faith belief it was removed or disabled because of mistake or misidentification; and (4) your name, address and telephone number, consent to the jurisdiction of the federal district court for the district where your address is located, or if outside the United States, any district where Uptify may be found, and a statement that you will accept service of process from the original notifier or its agent.

We forward a qualifying counter-notice to the original notifier, including the required contact details. Unless we receive notice that the notifier filed an action seeking a court order restraining the disputed activity, we will restore the material no earlier than 10 and no later than 14 business days after receiving the counter-notice, as the statute requires. Material may remain unavailable for a separate, independently applicable policy or legal reason, which we will identify where permitted.

5. Other claims and records

Use the listing report control or our legal contact for trademark, privacy, security, employer ownership or vendor-contract concerns. Explain your authority, the specific material and requested remedy. These issues do not automatically qualify for the DMCA counter-notice process. We may preserve relevant evidence and account records for legal needs. Paid access and refunds remain subject to the Terms and Refund and Cancellation Policy, and any mandatory legal remedy.
